If you were one of the many who received a text message that related to Mandee Stores from the dates of October 16, 2013 until December 31, 2014 with the message of “Welcome to VIP Status”, then you are not alone. Many of the people who received this particular message have been included in a settlement called the Unwanted Text Message TCPA Settlement. Even if you don’t qualify for this particular settlement, there are others that you might qualify for.
However, if you are one of the lucky ones who qualified for this settlement, then you have an estimated reward of at least $15 in merchandise vouchers or a $10 cash payment for the unwanted message to customers.
Mandee Stores announced that they would be willing to pay and provide each Class Member with either of the rewards. If you choose the $15 merchandise voucher, you receive a voucher for $15 that can be used at any of the Mandee Stores worldwide. If you choose to get the $10 cash payment, then you can easily get your cash by submitting a claim form before March 29, 2018.
This settlement has been in the works for quite some time, and after Mandee stores began sending unwanted messages to customers, it was necessary to take action against the store. Many customers to do not enjoy these unwanted messages, and when Mandee stores began sending them, customers became furious. This was when the class action lawsuit was begun.
Now that it’s time to start paying out rewards, you need to know how to qualify for that cash payment, if you decided to take it over the merchandise vouchers. In order to qualify for this cash payment option, you must provide your contact information, including your telephone number that received the unwanted text message. This text message was related to any Mandee Stores from the date of October 16, 2013 until December 31, 2014. The message must also read at the header, “Welcome to VIP Status!”.
If you are looking to get your cash payment, you must first file a claim. Simply fill out the claim file section, and submit your claim to the website. If you are a Settlement Class member, you are entitled to submit one form and one form only, regardless of the amount of text messages received between the two dates. You can also use only one claim for each given phone number. These restrictions are to ensure that no one is trying to take advantage of the class action settlement and get more than one cash reward or merchandise voucher per person or phone number.
January 2016 brought about the start of the class action lawsuit to help stop the practice of sending these unwanted text messages to the masses. It was Mandee Stores’ idea to help promote their clothing lines, but without consent, including any written consent, it is a violation of the Telephone Consumer Protection Act or the TCPA. Mandee Stores violated this act by sending mass text messages to customers.
Since the TCPA helps regulate telemarketing including that of text messages, written consent is required before any business can send out text messages to advertise their products. When businesses fail to comply with this rule, they can be liable for at least $1,500 per customer to which the messages were sent.
Unfortunately, Mandee Stores denies that this ever happened and that they violated the TCPA, but to keep from getting further litigation, the company finally consented to settle. Not only is Mandee Stores giving out the merchandise vouchers and cash payments, but they also agree to a change of their text message procedures and practices. This means that they will only send text messages if they have written consent from the recipients. On October 16, 2017, the settlement was granted the preliminary approval.

If you would like to exclude yourself from the settlement or even object to these terms of the settlement, you are required to act before February 2, 2018.
